These Terms of Service govern your use of BaitSync Discord bot hosting services. Please read them carefully before using our platform.

Acceptance of Terms

  • By accessing or using BaitSync services, you agree to be bound by these Terms of Service.
  • If you do not agree to these terms, you may not use our services.
  • We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance.
  • You must be at least 13 years old to use our services, or the minimum age required in your jurisdiction.

Service Description

  • BaitSync provides Discord bot hosting services including server infrastructure, deployment tools, and monitoring.
  • We offer various subscription plans with different resource allocations and features.
  • Service availability is subject to our uptime guarantees as specified in your selected plan.
  • We reserve the right to modify, suspend, or discontinue any part of our services with reasonable notice.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized access or security breaches.
  • One person or legal entity may not maintain more than one account without explicit permission.

Acceptable Use

  • You may only host Discord bots that comply with Discord's Terms of Service and Community Guidelines.
  • You may not use our services for any illegal activities or to distribute malware.
  • Bots must not engage in spam, harassment, or any form of abuse.
  • You may not attempt to circumvent resource limits or abuse our infrastructure.
  • API scraping, data harvesting, or automated attacks are strictly prohibited.
  • You may not resell or redistribute our services without written authorization.

Payment and Billing

  • Subscription fees are billed in advance on a monthly or annual basis.
  • All fees are non-refundable unless otherwise stated or required by law.
  • We reserve the right to change pricing with 30 days notice to existing subscribers.
  • Failed payments may result in service suspension until the balance is resolved.
  • You are responsible for all applicable taxes in your jurisdiction.

Service Level Agreement

  • Uptime guarantees vary by plan: Starter (99%), Pro (99.9%), Enterprise (99.99%).
  • Scheduled maintenance windows do not count against uptime calculations.
  • Service credits may be issued for downtime exceeding SLA guarantees.
  • Credits are calculated as a percentage of your monthly fee and applied to future bills.
  • Claims for service credits must be submitted within 30 days of the incident.

Intellectual Property

  • You retain all rights to the bot code and content you upload to our platform.
  • You grant us a limited license to host, run, and display your bots as necessary to provide our services.
  • BaitSync trademarks, logos, and service marks are our property and may not be used without permission.
  • We respect intellectual property rights and will respond to valid DMCA takedown requests.

Limitation of Liability

  • BaitSync is provided 'as is' without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount you paid us in the past 12 months.
  • We are not responsible for data loss; you are advised to maintain your own backups.
  • We are not liable for actions taken by Discord or third-party services.

Termination

  • You may cancel your subscription at any time through your account dashboard.
  • We may terminate or suspend your account for violations of these terms.
  • Upon termination, your bots will be stopped and data may be deleted after 30 days.
  • Termination does not relieve you of any outstanding payment obligations.
  • Provisions regarding liability, indemnification, and disputes survive termination.

Dispute Resolution

  • Any disputes will be resolved through binding arbitration rather than court litigation.
  • Arbitration will be conducted under the rules of the American Arbitration Association.
  • Class action lawsuits and class arbitrations are waived.
  • These terms are governed by the laws of the State of Delaware, USA.
  • You agree to resolve disputes individually, not as part of a class action.
